1. Agreement to These Terms

By accessing or using the YHAP app, website, and related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

If you use the Services on behalf of an entity, you represent that you have authority to bind that entity, and “you” includes that entity.

2. Privacy

If you upload health-related information (e.g., blood values), you acknowledge that this may be considered sensitive personal data in some jurisdictions.

3. Who Can Use YHAP

·       Age: The Services are intended for users 18+ (or the age of majority where you live).

·       Location: You may not use the Services where prohibited by law.

·       Account: You must provide accurate information and keep your account secure.

4. Important: Not Medical Advice

YHAP provides educational information and wellness-oriented insights. The Services:

·       do not provide medical advice, diagnosis, or treatment,

·       are not a substitute for professional healthcare, and

·       are not an emergency service.

If you have symptoms, a medical condition, or an emergency, contact a qualified healthcare professional or emergency services immediately.

5. Service Overview; Your Data Inputs

YHAP may allow you to enter information manually, upload blood test results, and receive algorithmic outputs such as scores, trends, and recommendations.

You are responsible for ensuring that any information you provide is accurate and that you have the right to upload it.

6. Your Responsibilities; Safe Use

You agree not to:

·       use the Services to break laws or violate others’ rights,

·       upload data about other people without permission,

·       attempt to reverse engineer, scrape, or disrupt the Services,

·       use bots or automated scripts to access the Services without our consent, or

·       post harmful, misleading, or abusive content in any community features (if applicable).

7. User Content and License

“User Content” includes information you submit or upload (including blood values, text, images, and files).

You retain ownership of your User Content. You grant YHAP a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content solely to provide and improve the Services, including generating your outputs and providing support.

8. AI/Algorithmic Outputs; No Guarantees

Outputs from the Services may be based on statistical models and algorithms. They may be incomplete, inaccurate, or not applicable to your situation. You acknowledge that results are provided “as is” for informational purposes and YHAP does not guarantee health outcomes, performance improvements, or accuracy.

9. Third-Party Services and Links

The Services may integrate or link to third-party services. Third-party services are governed by their own terms and policies. YHAP is not responsible for third-party services.

10. Targeted Advertising

We may show targeted ads or sponsored content based on your activity and device identifiers. You can manage ad preferences as described in our Privacy Policy.

11. Subscriptions and Payments

If you purchase a subscription, pricing, billing cycle, and features are shown at checkout. Subscriptions may auto-renew unless canceled. Refunds are handled according to applicable law and, where relevant, platform policies (Apple/Google).

12. Acceptable Use; Enforcement

We may investigate and take action (including suspension/termination) if we believe you violate these Terms or create risk or legal exposure.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or for security/legal reasons.

Upon termination, the license you granted ends except where we must retain certain information for legal, security, or legitimate business purposes (see Privacy Policy).

14. Intellectual Property

YHAP and its licensors own all rights in the Services, including software, designs, trademarks, and content (excluding User Content). No rights are granted except as explicitly stated in these Terms.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” YHAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YHAP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

IN NO EVENT WILL YHAP’S TOTAL LIABILITY EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO YHAP IN THE 12 MONTHS BEFORE THE EVENT OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, limitations apply to the greatest extent permitted.

17. Indemnification

You agree to indemnify and hold harmless YHAP from claims arising out of your use of the Services, your User Content, or your violation of these Terms or laws.

18. Governing Law; Consumer Rights

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws.

If you are a consumer in the EEA/UK/Switzerland, nothing in these Terms limits your mandatory consumer rights under your local law.

19. Dispute Resolution

For users located in the United States, disputes may be resolved through binding arbitration and may include a class action waiver, except where prohibited.

20. Changes to These Terms

We may update these Terms. We will post the updated version and update the “Last Updated” date. Material changes may be communicated in-app or by email.
